Expropriation is a complex and often contentious process,
involving significant legal, financial and emotional considerations. We act for
both expropriating authorities and private landowners across Ontario, offering
strategic guidance through every stage of the expropriation process. Our team
is engaged from project inception, supporting municipalities and public
agencies with environmental assessments, statutory documentation, compensation
negotiations and tribunal advocacy. Members of our team act for Metrolinx on
several large takings for new subway stations on the various new subway lines
as well as regarding the expropriation for and the establishment of new Transit
Oriented Communities. We also represent a wide range of private claimants, including
homeowners, developers and commercial tenants, helping them navigate complex
takings and secure fair compensation. With deep experience on both sides of the
table, we bring unmatched insight, precision and credibility to this highly
specialized area of law.
Our Expropriation Group, led by members of our Municipal
& Planning practice, brings together seasoned lawyers with deep expertise
in municipal, real estate, litigation, environmental, Indigenous and tax law,
ensuring a comprehensive, 360-degree approach to every file. Uniquely
positioned to serve both expropriating authorities and private landowner
claimants, we provide fast, accurate advice on determining the potential
highest and best use of an expropriated property. Every member of our team has
significant land use planning experience, enabling timely analysis of
applicable planning instruments that influence property valuation. This
capability is further strengthened by access to four in-house land use planners
who can quickly identify relevant planning instruments for any property in
Ontario, and four in-house conveyancers who review title instruments existing
at the time of expropriation—factors that can significantly impact market
value.
Our lawyers are recognized thought leaders in the field. Notably,
Christopher Williams, Andrea Skinner and Matthew Helfand are co-authors of Expropriation
Law in Ontario, 1st and 2nd Editions (LexisNexis), a leading legal book

Our core services include:
Strategic Project Planning & Environmental Compliance:
We advise on expropriation strategy, including process, timing and
avoidance of delaying tactics. Our team also assists with related environmental
assessments to ensure regulatory compliance and minimize project delays.
Statutory Documentation & Process Management: We
prepare and manage all required documentation under the Ontario
Expropriations Act, including notices, by-laws, plans, offers, agreements
and other materials. Our services also include conducting land title and
corporate searches and registering surveys and plans on title.
Stakeholder Engagement & Council Support: We
assist public authorities in drafting, preparing and presenting reports to
councils and expropriation bodies. For claimants, we provide strategic advice
on managing relationships with tenants, mortgagees and other parties impacted
by the taking.
Duty to Consult and Accommodate Indigenous Peoples: With
one of the Countries largest and most respected indigenous Practice Groups, we
can advise and ensure for public expropriating authorities that consultation
and accommodation obligations are met when expropriations may affect First
Nations lands, rights and interests.
For Indigenous clients impacted by an expropriation, we can
assist in addressing and integrating Aboriginal and treaty rights and ownership
interests into a fair, just and forward-looking outcome, including but not
limited to monetary compensation.
Expert Coordination & Evidence Development: We
help clients retain and manage key consultants, such as appraisers, business
valuators, environmental engineers, planners and surveyors, to build credible,
defensible evidence for both takings and compensation claims.
Hearings of Necessity Advocacy: We prepare submissions
and represent both authorities and claimants at Hearings of Necessity before
the Ontario Land Tribunal, advocating for or challenging the necessity of a
proposed expropriation.
Utility & Energy Sector Expropriations: We act for
utility companies in applications to the Ontario Energy Board for expropriation
orders and related approvals, ensuring compliance with sector-specific
regulations and facilitating timely infrastructure development.
Possession & Compensation Negotiation: We lead
negotiations to secure possession and fair compensation. For claimants, we
focus on maximizing recovery, minimizing tax liability and ensuring timely
payment. For authorities, we facilitate agreements that support efficient
project advancement.
Agreement Review & Risk Mitigation: We review and
negotiate expropriation-related agreements to ensure terms are fair,
enforceable and aligned with our clients’ long-term interests, protecting them
from future risk and uncertainty.
Mediation: We have extensive experience and success in
expropriation mediations both private and through the OLT. This includes the
selection of the appropriate mediators, preparation of mediation briefs
and materials, attendance before the mediators and follow up settlement
negotiations.
Tribunal & Court Advocacy: We represent clients
before the Ontario Land Tribunal and courts in connection with compensation
adjudication and collateral attacks on expropriation. Our litigation team
brings deep experience and a results-driven mindset to every proceeding.
