Canada’s healthcare sector is highly regulated and uniquely complex, shaped by demographic shifts, policy reform and technological advancement. The Aird & Berlis Healthcare Group brings real-world industry knowledge and strategic legal insight to help clients respond to change, manage risk and advance their clinical, operational and business objectives.
Our multidisciplinary team of lawyers and patent agents provides comprehensive legal and intellectual property services to a broad spectrum of healthcare sector clients. We work with hospitals, regulated health professionals, laboratories, clinics, long-term care and retirement homes, pharmacies, insurers, boards and foundations. We also advise dental support organizations (DSOs) and dental clinic networks, in addition to companies across the health sciences, biotechnology, pharmaceutical, life sciences and medical device sectors.
Our expertise has been consistently recognized in recent years. Our lawyers have been named in The Best Lawyers in Canada for Health Care Law since 2022, as well as featured in Lexpert’s Health Sciences Special Edition and acknowledged by Psychedelic Invest as a top firm specializing in psychedelics.
We draw on expertise from across the firm to offer a well-rounded perspective on the professional, business and personal challenges our healthcare clients face. Many of our lawyers have served in leadership roles on hospital and healthcare foundation boards. This experience gives us a practical understanding of the environments in which our clients operate.
Our clients include a leading international provider of private healthcare services, one of Canada’s largest dental clinic networks, the country’s largest mutual defence association for alternative healthcare providers, innovative pharmaceutical developers and one of the most technologically advanced hospitals in the country. We also advise professional associations, provincial healthcare agencies and numerous professional corporations and individuals.
Our core services include:
- Corporate & Commercial: We provide full-service corporate and commercial counsel, including professional corporation setup, structuring, transactions and contract negotiation. Our team drafts and negotiates agreements for research, licensing, financing, supply, service, privacy and procurement.
- Procurement: Our lawyers are recognized leaders in healthcare procurement, with experience advising on infrastructure, technology and e-Health projects. We prepare RFQs, RFPs and related documents, negotiate contracts and support clients in bid responses and procurement challenges.
- Privacy: We advise healthcare providers on compliance with the Personal Health Information Protection Act and other privacy laws. Our team also handles broader data protection and cybersecurity matters, especially in cross-border contexts.
- Infrastructure: We have advised on more than 20 major healthcare infrastructure projects, including public-private partnerships, project finance, procurement, real estate and construction. We represent all stakeholders, from governments and agencies to investors and service providers.
- Information Technology: We support hospitals and healthcare organizations with IT matters, including licensing, outsourcing, procurement and service agreements. Our advice integrates privacy and regulatory compliance to ensure secure, patient-focused solutions.
- Intellectual Property: We offer end-to-end IP services, from patent and trademark filings to portfolio strategy and litigation. Our clients include hospitals, pharmaceutical companies, healthcare organizations and research institutions, both in Canada and internationally.
- Labour & Employment: We advise on employment law, human rights, pay equity and workplace safety. Our labour law services include union relations, collective bargaining, arbitration and workplace investigations.
- Governance: Our governance expertise helps clients navigate strategic planning, restructuring and board-management relations. We also advise on interactions between hospitals, foundations and stakeholders.
- Foundations: We assist healthcare foundations with governance, gift planning, endowments and stakeholder relations, supporting their vital role in funding and community engagement.
- Financing: We advise on financing for healthcare facilities and professional corporations, including DSOs, dental networks, long-term care homes and specialty clinics. Our strong lender relationships and sector knowledge allow us to ensure smooth and well-structured transactions.
- Tax, Estate & Charitable Planning: We guide healthcare professionals, not-for-profits, and foundations on various tax and estate matters, including advance planning, charitable donations by donors and corporations, and gift and endowment advice for healthcare organizations.
- Professional Negligence: We provide counsel on professional liability, discipline, regulatory matters and civil litigation. We act as defence counsel to a national mutual defence association for healthcare professionals and offer mediation and ADR services for both healthcare providers and institutions.
We also advise on related areas such as real estate, commercial leasing and regulatory approvals.
The Aird & Berlis Healthcare Group understands that amid regulatory change, cost pressures and technological disruption, organizations across the healthcare landscape need legal advisors who can think ahead.
