An organization’s procurement processes set the tone for its interactions with contractors, suppliers and consultants. Whether fulfilling recurring needs under standing orders, procuring new office space, equipment or technology to grow your business, or procuring a major piece of public infrastructure, a strategic procurement process is needed to optimize your project and achieve your objectives.

Good procurement uses a combination of rigorous internal process and the law to bring commercial purchasing decisions to life. The procurement lawyers at Aird & Berlis provide comprehensive services by combining an in-depth knowledge of procurement law with best practices and processes.

We believe that good project results begin with a well thought out and planned procurement process. Our team of dedicated procurement lawyers can provide advice on all aspects of the procurement process, the design of the evaluation matrix and process, the application and impact of trade agreement requirements, the use of fairness commissioners, the bid protest process and what to do if things go wrong.

We act for both buyers and sellers, and on small procurements and large. Our experience spans the procurement of public infrastructure such as power plants, hospitals, roads and bridges, waste management facilities, transit projects, water and waste water facilities and many other goods and services. We act for both governments and private sector interests. We understand how procurements are financed and have decades of experience dealing with capital providers. In short, we have the experience you need to design and implement a procurement strategy that will extract the best results from the market. Or, if you are a seller or provider, we can advise you on how to get the most from your bid. Our services include drafting and negotiating bid requests, Requests for Expressions of Interest, Requests for Qualifications, Requests for Proposals, Requests for Tenders, and the definitive contract documents that arise from them. And we also provide procurement law opinions on complex issues ranging from bid compliance to the permissible scope of sole- or single-sourcing, to post-bid negotiating approaches in relation to bid re-scoping.

This all-around knowledge allows us to provide comprehensive, detailed advice focused on project success that benefits all parties.

Hand in hand with procurement is project delivery—the implementation of the project. We understand that an optimized procurement leads to optimized project delivery. We understand public-private partnerships, traditional general construction, design-build, progressive design-build, EPC(M), alliance and construction management, competitive dialogue, and we understand that each one requires a different perspective and approach. The procurement lawyers at Aird & Berlis have been involved in unique procurements leading to unique project delivery methods. We can assist at every stage of the procurement—from assessment and selection of the most appropriate procurement model to the drafting and negotiation of the procurement and accompanying contractual documents to selection of the winning bidder to post-bid project implementation and dispute resolution. We would be pleased to discuss how we can share our experience with you to enhance and give life to your commercial objectives.
