2023 was a year of change in the Canadian workplace, with major developments in legislation impacting employees, as well as court decisions which redefine the way wrongful dismissal actions will be addressed and interpreted.

In Ontario, the provincial government passed Bill 79, the Working for Workers Act, 2023, and introduced Bill 149, the Working for Workers Four Act, 2023, which, if passed, would amend several workplace laws to expand employee rights. The Supreme Court of Canada issued a precedent-setting decision, expanding health and safety obligations under Ontario's Occupational Health and Safety Act ("OHSA"). The importance of appropriately dealing with harassment claims in the workplace and off-duty conduct has never been more important.
