As 2023 reaches its halfway point, changes to Canadian workplaces continue at a rapid pace. Alongside updates to Canada’s Competition Act criminalizing wage-fixing and no-poaching agreements, Ontario’s Employment Standards Act has also undergone significant amendments that impact employers in Ontario.

Employers continue to deal with the aftershock of the COVID-19 pandemic, with hybrid and mixed-location workforces presenting an array of challenges that did not previously exist. This is further complicated by the labour shortage and challenges of attracting and retaining top talent. Employers continue to face issues concerning absenteeism and misconduct, which in severe cases may require the use of surveillance. All the while, the courts continue to issue decisions shaping how the common law will affect the workplace, including the legal implications of COVID-related leaves.
