Dealing with grievances is an important part of the unionized workplace. While most grievances are resolved through the grievance process, those referred to arbitration carry the risk of financial liability and can establish precedent that may restrict an employer’s ability to organize and operate efficiently. Although arbitration is often seen as a “mini trial,” the process can differ significantly, making careful strategy and preparation essential.

Join members of our Workplace Law Group for a practical webinar examining the grievance lifecycle and recent developments in labour arbitration. This session will focus on key considerations in responding to grievances, managing preliminary issues, and preparing for arbitration.

Topics include:

  • Arbitration triage: receiving grievances, determining response strategies and deciding which matters to settle or litigate
  • Preliminary issues: reviewing possible preliminary objections, including timeliness, past practice, estoppel and jurisdiction
  • Preparing for arbitration: effective preparation of evidence and witnesses
  • Recent labour arbitration decisions and case updates
