Compliance and Liability in the Era of Cannabis Legalization: Tips, Traps and Strategies for Employers

Canadian employers are required to ensure a safe workplace and environment for their employees. With the onset of legalized cannabis in Canada (and continued rise in medicinal marijuana use), workplace safety issues related to impairment at work are of growing concern.
Generally, there is no legal right to require or regulate employee drug testing, except post-accident or for safety-sensitive positions, such as those in the manufacturing, construction and transportation sectors. However, employers can be held accountable for related workplace accidents, injuries or deaths.
