Compliance and Liability in the Era of Cannabis Legalization: Tips, Traps and Strategies for Employers

Archive Now Available!

Lorenzo Lisi, Michael F. Horvat, Meghan A. Cowan and Fiona Brown

Canadian employers are required to ensure a safe workplace and environment for their employees. With the onset of legalized cannabis in Canada (and continued rise in medicinal marijuana use), workplace safety issues related to impairment at work are of growing concern.

Generally, there is no legal right to require or regulate employee drug testing, except post-accident or for safety-sensitive positions, such as those in the manufacturing, construction and transportation sectors. However, employers can be held accountable for related workplace accidents, injuries or deaths.

Join our panel of workplace law experts as they discuss ways to mitigate and manage the risks associated with employee cannabis use, both medical and recreational.

Topics include:

  • Employment Policies: How they can assist employers in avoiding liability, communicating expectations in the workplace and ensuring clear, consistent enforcement
  • Education: Why it’s important to conduct training and provide access to resources in order to shift perceptions and remove the stigma and discrimination related to cannabis use
  • Disciplinary Actions and Accommodation: Clarifying appropriate responses to medical and recreational cannabis use
