Aird & Berlis Successfully Obtains Injunction in Family Business Dispute
On November 27, 2023, the Honourable Justice Shin Doi of the Superior Court of Justice released her reasons for the decision in Cheema v. Dhaliwal, 2023 ONSC 6693. Aird & Berlis represented the Applicants and were successful in obtaining an injunction restraining the actions of the individual Respondent, who had unilaterally removed the Applicants from their positions as Directors and Officers of World Wide Carriers Ltd., a family-owned and operated trucking and logistics company, while asserting that he was the sole shareholder of the corporation. The underlying Application regarding the shareholdings of the corporation remains to be heard, however, her Honour’s Order ensures that the Applicants’ rights are protected and not prejudiced in the interim.
