The Future of Privacy Laws in Canada

CPD Information: 1 Substantive Hour for Lawyers

Paige Backman and Donald B. Johnston

ACCESS ARCHIVE

Rapidly changing privacy laws across Canada are bringing new obligations and financial risks to organizations. In Ontario, the government has launched a consultation to help strengthen privacy protections in the province. Meanwhile, Bill 64 was introduced in Quebec to strengthen consent, transparency and accountability through imposing higher penalties and mandatory breach notification requirements. How will these new regulations impact your organization and what can you do to make sure you are compliant?

Join our panel of privacy experts as they provide key takeaways on these regulations, discuss privacy guidance recently released by the Office of the Privacy Commissioner for manufacturers of Internet of Things devices and answer frequently asked questions about required consent, transborder data flow and other privacy-related matters.

Topics include:

  • New privacy guidance on the Internet of Things for manufacturers and Canadians
  • Bill 64 - Proposed changes to Quebec's privacy laws
    • Plain language seeking of specific consent "separate from any other information provided"
    • Clear service provider exemption (contrary to attitude at Privcom.gc.ca)
    • Commercial transaction exemption (similar to PIPEDA)
  • CRTC expands role in imposing significant financial penalties
  • Required consent (express, separate express or implied) and transborder data
  • Ontario IPC public consultation paper on "Reforming Privacy in Ontario's Private Sector"
