David Reiter and Jody Johnson Successfully Represent Pickering’s Compliance Audit Committee

David Reiter, a partner in the firm’s Litigation Group, was appointed earlier this year as independent prosecutor by the City of Pickering’s Compliance Audit Committee. The committee, upon receipt of requests from the public, ordered a compliance audit of Councillor Doug Dickerson’s campaign finances which disclosed apparent contraventions of the Municipal Elections Act, 1996.  Jody Johnson, an associate in the firm’s Municipal and Land Use Planning Group, successfully defended an appeal of the committee’s decision to order the compliance audit.
 
In his capacity as independent prosecutor, David laid five charges in February 2013 after conducting his investigation. The matter resolved on July 19 when Councillor Dickerson pleaded guilty to two charges under the Municipal Elections Act, 1996. In that resolution, he repaid nearly $30,000 to the City and was fined $17,000 for filing an inaccurate financial report and $500 for exceeding his spending limits. As far as we know, in Ontario, this is the most significant penalty ever imposed under the Municipal Elections Act, 1996.
